Welcome to dimondexcavation.com (the “Website”). The Website is owned and operated by Dimond Excavation LLC (“Dimond Excavation,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the Website.
By accessing or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Website.
Informational Purpose
Unless we expressly state otherwise, Website content is provided for general informational and promotional purposes only. Nothing on the Website is a binding offer, quote, guarantee, warranty, or commitment to provide any service.
Information on the Website is not engineering, geotechnical, surveying, legal, or other professional advice. Consult an appropriately qualified professional about your specific circumstances.
Estimates, Project Content, and Site Conditions
Any scope, timeline, or availability information on the Website is general and illustrative. It is not an estimate, bid, or quote for your project. A binding estimate is provided only in a separate written document issued by us for a specific property and scope, and work proceeds only under a signed written agreement.
Photographs and project examples on the Website illustrate the type and quality of work we do. They are not a representation that your project will produce the same appearance, timeline, or outcome. Excavation results vary with soil, drainage, access, weather, permitting, materials, utility locations, and scope.
Any registration, licensing, bonding, or insurance information published on the Website is accurate as of the date shown and is subject to change. You may verify current status with the issuing authority.
Nothing on the Website substitutes for required permits, inspections, utility locating, or compliance with applicable codes and regulations. Idaho law requires notice before excavation. Call 811 before you dig.
Changes to the Website and Terms
We may modify, suspend, or discontinue any part of the Website at any time without notice. We may also update these Terms. Changes take effect when posted on this page unless otherwise stated, and we will update the “Last updated” date. Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
Intellectual Property
The Website and its contents, including text, photographs, graphics, logos, designs, page layouts, trademarks, and service marks, are owned by or licensed to Dimond Excavation and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Website for lawful personal or internal business purposes, including evaluating and purchasing our services. You may not copy, reproduce, modify, distribute, display, publish, transmit, create derivative works from, sell, license, or otherwise exploit Website content without our prior written permission, except as permitted by applicable law.
Acceptable Use
You agree that you will not:
- Use the Website in violation of any applicable law, regulation, or third-party right.
- Use the Website for fraudulent, deceptive, harassing, abusive, defamatory, obscene, or otherwise unlawful purposes.
- Attempt to interfere with, disrupt, damage, disable, overburden, or gain unauthorized access to the Website, its servers, or its networks.
- Introduce viruses, malware, or code intended to interrupt, damage, or limit the functionality of the Website or another person’s device.
- Remove, obscure, or alter proprietary notices or security features.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
Automated Access
We permit search engines, answer engines, and other automated agents to access, index, and cite the Website in accordance with the directives published in our robots.txt file. Those directives govern permitted automated access.
Without our prior written permission, you may not:
- Access the Website by automated means in a way that circumvents our robots.txt directives, evades rate limits or access controls, or places an unreasonable load on our infrastructure.
- Systematically extract, copy, or compile Website content in bulk to create or populate a competing product, service, dataset, or directory.
Nothing in this section restricts activity that applicable law protects or permits.
Your Submissions
If you submit information, feedback, photographs, or other content through the Website, you represent that you have the right to provide it and that it does not violate law or the rights of another person. You keep ownership of what you submit. To the extent necessary for us to operate and improve our Website and services and to respond to you, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display it for those purposes.
Do not submit confidential or sensitive personal information unless we specifically request it through a secure process.
Electronic Communications
When you use the Website or send us email or a form submission, you are communicating with us electronically and you consent to receive communications from us electronically. Notices and disclosures we provide electronically satisfy any legal requirement that they be in writing, unless applicable law requires otherwise.
Third-Party Services and Links
The Website may link to or include content from third-party websites or services. Those third parties are responsible for their own content, availability, security, and policies. We do not control and do not endorse them unless expressly stated. Your use of third-party services is governed by their own terms and privacy policies.
Accessibility
We are committed to making the Website accessible. See our Accessibility Statement for our commitment, known limitations, and how to report a barrier.
Disclaimers
To the fullest extent permitted by law, the Website and all content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and freedom from viruses or other harmful components.
We do not warrant that the Website will be uninterrupted, error-free, or secure; that defects will be corrected; or that Website content will be complete, current, or accurate.
This section applies to the Website only. It does not limit, waive, or disclaim any warranty we provide in a separate written agreement for our services.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions above may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, Dimond Excavation and its owners, officers, employees, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, use, goodwill, or business opportunity, arising out of or related to your use of, or inability to use, the Website or its content, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability arising out of or related to the Website or these Terms will not exceed the greater of: (a) the amount you paid us, if any, to use the Website in the 12 months before the event giving rise to liability; or (b) $100.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, personal injury, or death caused by negligence. Some jurisdictions do not allow certain limitations of liability, so some limitations above may not apply to you.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Dimond Excavation and its owners, officers, employees, agents, affiliates, licensors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your violation of these Terms, your misuse of the Website, or your violation of another person’s rights.
Governing Law and Venue
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. Except where applicable law requires otherwise, any dispute arising out of or related to these Terms or the Website must be brought exclusively in the state or federal courts located in Gooding County, Idaho, and you consent to the personal jurisdiction and venue of those courts.
Relationship to Other Agreements
If there is a conflict between these Terms and a separate written agreement signed by Dimond Excavation, such as a proposal, estimate, or service agreement, the separate agreement controls with respect to its subject matter.
Severability, Waiver, Assignment, and Survival
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign these Terms without our prior written consent. We may assign them in connection with a business transfer. The sections titled Intellectual Property, Your Submissions, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Venue, and this section survive termination of your use of the Website.
